Marsilen Terms of Service

Effective Date: February 25, 2026 These Terms of Service (“Terms”) govern your access to and use of the website www.marsilen.de / .com (the “Site”) and any related services (collectively, the “Service”), operated by Marsilen GmbH (“we,” “us,” or “our”). By accessing or using the Service, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Age Restriction & Verification

The Service and products (e-cigarettes, nicotine liquids, and related items) are intended exclusively for adults aged 21 and over. By accessing the Site or purchasing, you represent and warrant that you are at least 21 years old and of the legal purchasing/smoking/vaping age in your jurisdiction. We use industry-leading age verification software to verify all orders; we may transmit necessary data (name, address, date of birth) to third-party providers. This requirement exceeds the minimum legal age in most EU jurisdictions (typically 18 under national implementations of the Tobacco Products Directive 2014/40/EU). Failure to verify may result in order cancellation.

2. Health & Product Warnings

Nicotine is highly addictive. Our products are not suitable for non-smokers, pregnant or breastfeeding women, persons under 21, or individuals with heart disease, respiratory conditions (e.g., asthma, emphysema), ulcers, liver/kidney issues, thyroid disorders, or other health conditions. Read all warnings on packaging. This product may expose you to chemicals including formaldehyde (known to cause cancer) and nicotine (known to cause birth defects or reproductive harm) – for more info, see https://www.P65Warnings.ca.gov (California Prop 65 reference). Products comply with EU Tobacco Products Directive but are sold “as is.”

3. Online Store Terms

You must be of legal age to use the Service. Products are for personal use only and not for illegal purposes or to violate laws (including IP infringement). You agree not to introduce viruses, worms, or destructive code. Breach may result in immediate termination of access.

4. General Conditions

We reserve the right to refuse service, cancel orders, or limit quantities to any person, household, or order at any time. Content transmission may be unencrypted (except payment data). No reproduction, duplication, copying, selling, or resale of the Service without our express written permission.

5. Accuracy of Information

Product descriptions, pricing, availability, and images are provided for general information and may contain inaccuracies or omissions. We do not warrant completeness or timeliness. Reliance is at your own risk. We may correct errors (including post-order) without notice.

6. Modification of Service and Prices

We may modify, discontinue, or change prices of products/services at any time without notice or liability.

7. Products or Services

Products may have limited availability or be exclusive to the Site. Colors/images may vary by device; no guarantee of accuracy. We may limit sales to certain persons, regions, or quantities and discontinue products without liability.

8. Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information and to update it promptly. We may refuse or cancel orders if information appears inaccurate or if we suspect unauthorized/reseller activity. Review our separate Refund Policy for details.

9. Optional Third-Party Tools & Links

Third-party tools/links are provided “as is” without warranties. We have no liability for your use of them. Review third-party terms. Third-party content is not our responsibility.

10. User Submissions & Feedback

Any comments, feedback, or submissions you provide may be used, edited, published, or distributed by us without compensation or obligation to respond or maintain confidentiality. You warrant your submissions do not violate third-party rights or contain unlawful/offensive material.

11. Prohibited Uses

You may not use the Service for illegal purposes, to infringe IP, harass, defame, discriminate, spread false information, introduce malware, collect personal data without consent, spam, or interfere with security. Violations may result in termination.

12. Disclaimer of Warranties; Limitation of Liability

The Service and products are provided “as is” and “as available” without warranties of any kind (express or implied, including merchantability, fitness for purpose, non-infringement). We do not guarantee uninterrupted, error-free, or secure use. To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, special, or punitive damages (including lost profits, data loss) arising from use of the Service/products, even if advised of the possibility.

13. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates from any claims, losses, liabilities, or expenses (including attorneys’ fees) arising from your breach of these Terms, violation of laws, or infringement of third-party rights.

14. Right of Withdrawal (EU Consumers)

EU consumers have a statutory 14-day right of withdrawal from receipt of goods (Directive 2011/83/EU). Exclusions apply to opened/sealed liquids and e-cigarettes for hygiene reasons. See separate Withdrawal Policy for details.

15. Termination

These Terms remain in effect until terminated. We may terminate your access for any breach without notice. Pre-termination obligations survive.

16. Severability

If any provision is invalid, the remainder remains enforceable.

17. Entire Agreement

These Terms (plus referenced policies) constitute the entire agreement and supersede prior understandings.

18. Governing Law

Governed by the laws of Germany, excluding the UN Sales Convention. For EU consumers, jurisdiction is your place of residence; otherwise, Berlin courts.

19. Changes to Terms

We may update these Terms by posting changes. Continued use constitutes acceptance. Check periodically.
